I don't honestly think they disregard it. They have to, by law, manage to a specific number.
Now, with their hands tied even more, they will need to keep the areas that are low in population artificially low because they can't use EAB in the units that are largely over populated. It's how the government works. They write poorly thought out laws and regulations that benefit one group or another so as not to disenfranchise them that ends up disenfranchising all the other groups and the general public.
